Through this Privacy Notice (hereinafter, the “Notice”), and in accordance with the provisions contained in the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and other applicable provisions in force in Mexico (collectively, the “Law”), the terms under which your Personal Data (as defined below), provided to us by any means, will be obtained, used, disclosed, or stored (hereinafter, any of these actions individually or collectively referred to as “Processing”) are described.
Representaciones Artísticas Apodaca, S.A. de C.V. (“Apodaca” or “we”), as the data controller, as defined in the Law, with registered address at Av. Jerónimo Treviño Oriente 1549, Monterrey Centro, 64000, Monterrey, Nuevo León, establishes the aforementioned address as its official domicile for all purposes and obligations related to this Notice.
At Apodaca, we are committed to protecting the privacy of Data Subjects. The term “Data Subject(s)” refers to any natural person who, by any means, provides us with one or more of their Personal Data for the purposes stated in this Notice.
We will collect a wide variety of information related to you (the “Personal Data”). The purposes for which we use this information are listed below. If we process your information for any other purposes, we will inform you at the appropriate time.
This purpose refers to confirming the identity of the Data Subject as necessary to fulfill the purposes established in this Notice, and may involve verifying the age of majority of the Data Subject prior to their access to any official pages, applications, or platforms of Apodaca and/or participation in promotional activities or events organized by Apodaca, whether in person or online.
This purpose refers to various activities carried out by Apodaca, its affiliates, and/or subsidiaries in order to offer, market, personalize, and improve our products and services, establish, maintain, and execute a commercial and/or business relationship with the Data Subject, and the creation, updating, and management of the Data Subject’s account on our official websites, platforms, and applications.
This purpose includes cases in which we need to resolve performance issues of our official websites, platforms, and applications, including troubleshooting, data analysis, testing, system maintenance, support, reporting and data storage, improving the availability of our official websites, platforms, and applications, and protecting them against any kind of fraud or misuse.
This purpose refers to the participation of the Data Subject in purchase promotions, raffles, and prize draws (including giveaways), whether in person, online, through mobile devices, social media, and applications, as well as geolocation-based activities and promotions (including SMS text messages and gamification).
This purpose refers to the Processing of Personal Data of the Data Subjects as necessary to carry out any activity aimed at fulfilling a legal obligation or requirement, or a recommendation from an authority to which Apodaca, its affiliates, or subsidiaries are subject, including the disclosure of Personal Data to governmental or supervisory authorities, such as tax, administrative, and/or judicial authorities.
This purpose includes activities such as addressing and following up on the Data Subject’s questions, complaints, or comments regarding our products and/or services. For this reason, telephone calls, emails, or any other type of communication between the Data Subject and Apodaca may be recorded. This also includes sending invitations to events or offering suggestions about our various products and services that may interest or benefit you, as well as evaluating the quality of our products and/or services and conducting satisfaction surveys.
This purpose refers to the activities we carry out to improve our marketing strategies by creating an audience based on segmented profiles in order to send them tailored offers and content, particularly when we use personal data management platforms or receive Personal Data from social media platforms. The data used for these purposes may be encrypted and later decrypted, either directly by us or through third parties.
This purpose refers to activities such as sending advertising information about our products, developing and sending marketing or advertising campaigns to offer products and/or services from Apodaca, its affiliates, subsidiaries, and/or business partners.
If you do not wish your Personal Data to be Processed for non-essential purposes, you may, from this moment, send an email to [email protected] expressing your refusal for such purposes. Please note that refusing the use of your Personal Data for non-essential purposes will not be a reason for us to deny you any of our products or services.
Apodaca carries out the Processing of the Personal Data of the Data Subjects only for the duration during which the data remains valid and/or the Processing is necessary to fulfill Apodaca’s own purposes and/or a legal obligation.
- Identification data, such as name, age, among others.
- Contact data, such as email address, among others.
- Data on physical characteristics, such as facial features, and generally any information related to a person's particular physical traits.
Additionally, we collect information about how you use our products, services, and official websites, platforms, and applications, such as IP address, cookies, mobile device ID, login data, browsing history, browser type and version, clicks, time zone settings and location, visited pages (including date and time logs), browser plugin types and versions, operating systems, platforms, and information from other technologies on the devices you use to access our official websites, platforms, and applications.
This includes any information you share with Apodaca through any of your social media accounts, in the event that you use them as a means of registration on our official websites, applications, and platforms.
We also collect, use, and share Disassociated Personal Data (“Disassociated Personal Data”), such as statistical and demographic information, in order to fulfill any of the purposes set forth in this Notice. Disassociated Personal Data may be derived from certain Personal Data, but is not considered such under applicable regulations, as it cannot be linked to the Data Subject nor does it allow their identification due to its structure, content, or level of disaggregation. However, if we combine or connect Disassociated Personal Data with your Personal Data to the extent that such disassociated data can identify you directly or indirectly, the combined information will be treated as your Personal Data and, therefore, will be handled in accordance with this Privacy Notice.
In the event you provide Apodaca with Personal Data other than those listed in this Notice, and if such Data is proportional to the purposes contained herein, Apodaca may Process said Data solely and exclusively to fulfill the stated purposes, and the provision of such Data will be understood as your consent for us to perform such Processing.
We obtain your Personal Data directly, when you provide it to us in person or through electronic means such as email, our official websites, applications, platforms, and/or official social media, or via telephone; or indirectly, when we receive your Personal Data from a third party or from a social media platform or media outlet.
Apodaca may collect Personal Data at the beginning of the legal or commercial relationship with the Data Subject, or during its term and development. Any Personal Data collected by Apodaca during the course of the legal or commercial relationship with the Data Subject will be subject to Processing as outlined in this Privacy Notice.
Apodaca personnel will only have access to your Personal Data when it is necessary to perform their job or to fulfill any of the purposes described in this Notice.
- Apodaca’s affiliated and/or subsidiary companies, for the purpose of centrally providing various processes and services, due to the national and international nature of the information technology systems shared between companies.
- Third-party providers of products or services. These products or services may include marketing services, advertising, marketing service platforms, digital marketing strategies, and the creation and design of contests, raffles, and prize draws, as well as information technology systems.
- Professional consultants, such as accountants, auditors, or lawyers.
- Government authorities, in order to comply with any legal or judicial obligation.
The aforementioned third parties may be located in Mexico or in any other part of the world. When your Personal Data is stored outside of Mexico, we will ensure it receives an adequate level of protection. We require our product or service providers and professional consultants to establish and maintain appropriate security measures to ensure the safety and confidentiality of your Personal Data, through strict standards and legal agreements.
We will establish and maintain administrative, technical, and physical security measures in order to protect your Personal Data against damage, loss, alteration, destruction, or unauthorized use, access, or processing, taking into account possible risks. These measures will always align with legal and industry standards.
We will retain your Personal Data for as long as legally permitted, while it is necessary to fulfill any of the purposes established in this Notice or any applicable legal requirement or obligation, or as long as permitted by any applicable statute of limitations. We will take the necessary steps to destroy or dissociate any Personal Data in our possession when it is no longer required to meet the aforementioned purposes or once the retention period has ended.
In the event that, in order to fulfill the purposes stated above, Apodaca processes the Personal Data of third parties related to you (such as a partner or spouse, children, dependents, and/or personal references; each of them a “Related Third Party”), you are obligated to share the contents of this Privacy Notice with said Related Third Party and to obtain their consent so that Apodaca may process and use (including transfer and disclosure) their Personal Data in accordance with the purposes provided in this Notice.
By providing us with the Personal Data of a Related Third Party, you imply that you have obtained their consent and have made this Privacy Notice available to them, as described above. Therefore, it is your responsibility to hold Apodaca harmless from any liability arising from any complaint or claim that such Related Third Party may bring against us.
Keep your Personal Data up to date and inform us of any significant changes to your data or that of your Related Third Parties by sending an email to [email protected].
You have the right to request access to your Personal Data that is being processed by Apodaca or any third party acting on its behalf, and to know the details of such Processing. You also have the right to rectify, cancel, delete, or restrict (as applicable), or to object to the Processing of your data, always in accordance with the provisions of the Law, other applicable regulations and laws, and Apodaca’s internal guidelines.

Apodaca will inform you, through the contact means you provide in your request, whether it was granted, within a maximum of 20 business days from the date the corresponding request was received.

“Cookies” and similar technologies are sometimes necessary to remember your account settings, language, and the country you are located in, but they also allow us to measure and analyze your behavior on our website, applications, and official platforms, as well as to show you personalized advertising.
